1. Acceptance of Terms

By accessing or using any service, website, or product offered by EZ4UBiz, LLC (“Company,” “we,” “us,” or “our”), you (“Client,” “user,” or “you”) agree to comply with and be legally bound by these Terms of Service and our Privacy Policy. If you do not agree, please discontinue use of all EZ4UBiz services immediately.

2. Services Provided

EZ4UBiz provides web, marketing, and business automation services, including but not limited to:

• CRM and lead management
• Website and funnel design, hosting, and maintenance
• SMS, email, and automation marketing
• Reputation and review management
• Appointment scheduling and pipeline management
• AI-powered customer retention and business optimization tools

All services are subject to change, enhancement, or discontinuation at the Company’s discretion in compliance with applicable law.

3. Account Registration & Responsibility

To access certain services, you may need to create an account. You agree to:

• Provide accurate and complete information during registration.
• Maintain the confidentiality of your login credentials.
• Notify us immediately of any unauthorized access to your account.

Sharing or reselling your account is strictly prohibited. EZ4UBiz is not liable for unauthorized account use caused by your negligence.

4. Billing & Payments

Service fees and billing terms are defined in your individual client agreement. Unless otherwise specified, payments are non-refundable. You authorize EZ4UBiz to charge your payment method on a recurring or one-time basis as agreed. Failure to pay invoices on time may result in suspension or termination of services. Clients remain responsible for all outstanding balances.

EZ4UBiz complies with federal and state electronic transaction laws, including the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN Act).

5. Use of Services

Clients agree not to use EZ4UBiz services for illegal, harmful, or fraudulent purposes. Prohibited uses include, but are not limited to:

• Sending spam or unauthorized marketing communications
• Hosting or transmitting harmful, abusive, or discriminatory content
• Violating any applicable federal, state, or local laws (including CAN-SPAM, TCPA, or CCPA)

Violation of these restrictions may result in immediate account termination and legal action.

6. Data & Privacy Compliance

EZ4UBiz handles all user and client data in compliance with applicable federal and state data protection laws, including but not limited to:

• California Consumer Privacy Act (CCPA/CPRA)
• Texas Data Privacy and Security Act (TDPSA)
• New York SHIELD Act
• Arizona Data Privacy Act
• Federal Trade Commission (FTC) Privacy Guidelines

Clients using our CRM or marketing tools must obtain prior, documented consent from their contacts before sending marketing messages. EZ4UBiz assumes no responsibility for data misuse or unauthorized outreach initiated by clients.

7. SMS/Text Message Consent

By providing your phone number to EZ4UBiz, you expressly consent to receive informational and marketing SMS/text messages from or on behalf of EZ4UBiz, including messages sent via an automatic telephone dialing system (“autodialer”) or other technology. These messages may include updates, promotions, account alerts, or service information.

Consent to receive texts is not a condition of any purchase. Standard message and data rates may apply depending on your carrier and plan.

You may opt out at any time by replying STOP to any message received or by contacting us directly at [email protected]. You may also request assistance by replying HELP.

EZ4UBiz complies with all applicable federal and state communications laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and state-specific text marketing regulations in California, Texas, New York, and Arizona.

8. Intellectual Property

All software, technology, content, and trademarks provided by EZ4UBiz remain the exclusive property of the Company or its licensors. You may not copy, modify, distribute, reverse-engineer, or resell any part of the service without written permission.

9. Termination & Suspension

EZ4UBiz may suspend or terminate accounts under the following conditions:

• Violation of these Terms
• Non-payment of invoices
• Fraudulent or abusive behavior

Clients may cancel at any time by providing written notice. No refunds will be issued for services already rendered or billed.

10. Limitation of Liability

To the maximum extent permitted by law, EZ4UBiz, its affiliates, and partners shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the platform or services.

Total liability shall not exceed the amount paid by you to EZ4UBiz within the thirty (30) days prior to the claim event. Some states (including CA and NY) do not allow certain liability exclusions, so portions of this limitation may not apply to you.

11. Dispute Resolution & Arbitration

In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Travis County, Texas, in accordance with the Federal Arbitration Act and the rules of the American Arbitration Association.

Each party waives the right to participate in a class action or jury trial, to the fullest extent allowed by law.

12. Governing Law

These Terms are governed by the laws of the State of Texas and applicable United States federal law, without regard to conflict-of-law principles. EZ4UBiz complies with state consumer protection acts including those of California, Arizona, and New York.

13. Modifications

EZ4UBiz reserves the right to update or modify these Terms of Service at any time to comply with changes in law or business practices. The latest version will always be available at https://biz.ez4ubiz.com/terms_of_service. Continued use of our services after updates constitutes acceptance of the revised Terms.
