1. Parties & Scope

This Agreement is between EZ4UBiz, LLC and the individual or entity (“Client,” “you,” or “your”) purchasing or using our services. It applies to all services offered by EZ4UBiz throughout the United States.

2. Scope of Services

• Branding & Logo Creation
• AI-Powered Marketing Automation & CRM Systems
• Email, SMS, and Social Media Campaigns
• Sales Funnel & Workflow Development
• Merchant Account Setup & Integrations
• Reputation & Review Management
• Business Consulting, Strategy & Analytics
• Licensed CPA or Tax Packet Setup (if applicable)

Disclaimer: Purchasing a service package does not guarantee launch or specific results. Success depends on client participation, timely communication, and completion of required setup items such as hosting, SSL, and domain configuration.

3. Communication, SMS & Text Consent

EZ4UBiz communicates with clients via phone, email, and text (SMS/MMS) for project updates, approvals, scheduling, and account notifications. By providing your mobile number, you consent to receive text messages from EZ4UBiz as described below.

SMS/Text Messaging Consent Disclosure

• Explicit Consent: By submitting your phone number through our website, forms, checkout pages, or written agreements, you authorize EZ4UBiz, LLC to send you transactional and informational text messages related to your account, services, or projects.
• Purpose: Messages may include appointment reminders, project updates, account verifications, billing notices, and customer support communications.
• Frequency: Message frequency varies but is limited to necessary and relevant updates. We avoid marketing spam or unrelated promotions.
• Opt-Out: You may opt out at any time by replying “STOP” to any message or emailing [email protected]. You will receive one final message confirming your opt-out.
• Help: For assistance, reply “HELP” or contact [email protected] or call (480) 466-8952.
• Message & Data Rates: Message and data rates may apply depending on your mobile carrier. EZ4UBiz is not responsible for these charges.
• Privacy: Your phone number will only be used for authorized communications. We never sell, rent, or share your mobile number with unaffiliated third parties. See our Privacy Policy for more details.
• Compliance: EZ4UBiz complies with the Telephone Consumer Protection Act (TCPA), FCC Regulations, and CTIA Messaging Principles.

Business Hours: Monday–Friday, 9:00 AM – 5:00 PM (MST). Messages may be sent only during permissible hours per federal and state guidelines. If a client fails to respond within 30 days, the project may be paused until reactivated.

4. Change Orders

All change requests must be emailed to [email protected]. Complex or custom requests may require adjusted timelines or costs. EZ4UBiz may decline changes beyond the agreed project scope.

5. Payment, Refunds & Cancellations

• Payment: Services begin after verified payment.
• Refund Policy: You may cancel within three (3) business days for a full refund under the FTC Cooling-Off Rule (16 CFR § 429).
• After 3 Days: Refunds are reviewed case-by-case depending on progress.
• No Refunds After Fulfillment: Once services or digital assets are completed, refunds are unavailable.
• Taxes & Fees: Client is responsible for applicable taxes, merchant fees, and third-party costs.

6. Online Asset Management

EZ4UBiz may need access to domains, hosting, or CRMs to fulfill contracted work. Accounts remain in your name unless otherwise agreed. Auto-renewal may be enabled to prevent lapses.

7. Data Privacy & AI Usage

EZ4UBiz complies with federal and state privacy laws, including CCPA/CPRA (CA), TDPSA (TX), NY SHIELD Act, Arizona Consumer Fraud Act, Virginia CDPA, and FTC Data Protection Standards.

AI-powered tools may process limited client data to deliver or improve services. Data is encrypted in transit and stored securely. We do not sell or rent your information. See our Privacy Policy for full details.

8. Limitation of Liability

EZ4UBiz, LLC is not liable for indirect, incidental, or consequential damages (including data or profit loss). Total liability shall not exceed the amount paid for the service in question. Where restricted, this limitation applies to the fullest extent allowed by law.

9. Dispute Resolution & Governing Law

Disputes will first be handled informally. If unresolved within 30 days, parties agree to non-binding mediation in Travis County, Texas before litigation. This Agreement is governed by Texas law with recognition of all applicable state and federal consumer-protection rights.

10. Force Majeure

EZ4UBiz is not responsible for delays or failures caused by events beyond our control, such as natural disasters, cyberattacks, or government restrictions.

11. Amendments & Entire Agreement

We may update these Terms to reflect legal or operational changes. The latest version is available at https://biz.ez4ubiz.com/terms-and-conditions. Continued use constitutes acceptance. This document plus your invoice or signed contract forms the entire agreement between you and EZ4UBiz, LLC.
